ANCESTRAL DOMAIN CONFLICT AMONG THE BLAAN TRIBE IN BARANGAY SAN JOSE, GENERAL SANTOS CITY

Abstract

The general content of this paper revolved around the ICC/IPs in San Jose in ancestral land conflict, the different actors interact in the land dispute situation; and the effectiveness of the mechanism and procedures in resolving the land dispute in Barangay San Jose. This paper aims to show the mechanism and procedures observed by the Barangay Council and the tribal chieftain to settle the disputes in their area of jurisdiction of Barangay San Jose, General Santos City.

With the application of qualitative and descriptive research design, this study used structured interviews for the Key Informant Interview (KII). Five informants from the ICC/IPs who experienced land conflict were interviewed and five representatives from the legal basis in resolving land disputes of the ICC/IPs.

The study found out that ICC/IPs were engaged in ancestral land conflict because they wanted to claim the inheritance of their ancestors. There are different perspectives actors interact in land disputes situation in Barangay San Jose. Hence, these are the "Blaan vs. Blaan" and "Blaan vs. Christians" or the settlers.

Finally, IPRA Law has great effective mechanism and procedures in resolving land disputes to help the ICCS/IPs to settle land disputes in their jurisdiction however, the mechanisms and procedures observed by the Lupon Tagapamayapa in Barangay San Jose, General Santos City, are not effective remedies to settle land disputes among the individual that were involved in the land conflict because of the limitation of the law.
